These terms govern the supply of virtual private server hosting under the VPSWala brand. VPSWala is a brand operated by Advika Web Developments Hosting Private Limited (CIN U72200RJ2011PTC034353), which is the contracting entity for every VPSWala service. Ordering, billing and the client area run on the StreamData Networks platform, which is operated by the same group.
By ordering a service you accept these terms and the acceptable use policy, which forms part of them.
1. Service description
We supply a virtual private server with the vCPU, memory, storage and monthly transfer allowance stated in your order, running on KVM hardware virtualisation. You receive root or administrator access from first boot.
Unless separately agreed in writing, the service is unmanaged. We are responsible for the host platform, the network and provisioning. You are responsible for everything inside the virtual machine, including the operating system, packages, configuration, application code and data.
2. What is not included
The following are quoted and charged separately and do not form part of the published plan price: goods and services tax and any other applicable taxes; Windows Server licensing; control-panel licensing such as cPanel, WHM or Plesk; managed operating-system or application administration; off-server backup retention; and additional IPv4 addresses.
3. Fees, billing and taxes
Published prices are monthly, in Indian rupees, exclusive of GST. Our GSTIN is 08AAJCA2451R1Z7. Where you supply a valid GSTIN, tax invoices are raised in your registered company name so that input tax credit can be claimed.
Service is provided on a prepaid basis for the billing cycle selected at order. Renewal invoices are issued in advance of the cycle. Where an invoice remains unpaid for more than 7 days after its due date, the service may be suspended; continued non-payment may lead to termination and deletion of data.
4. Service levels
Any availability commitment, service credit, response time or DDoS mitigation scope applies only where it is expressly stated in your quotation or a signed service agreement. Marketing material, including this website, does not create a service level.
5. Your responsibilities
You must keep the operating system and applications patched, secure your credentials, configure your own firewall policy, and maintain your own backups. You are responsible for all activity originating from your server, including activity by anyone to whom you grant access.
6. Backups
No off-server backup retention is included in the published plan price. A snapshot held on the same storage as the workload is not a backup. See the backup policy.
7. Suspension and termination
We may suspend a service where it presents a security risk to the platform or to other customers, where it breaches the acceptable use policy, where it attracts network abuse that threatens platform stability, or where an invoice remains unpaid beyond the grace period in clause 3. Where circumstances permit, we will notify you before suspending.
You may cancel at any time through the client area, effective at the end of the current billing cycle. See the refund and cancellation policy.
8. Data on termination
After termination the virtual machine and its storage are scheduled for deletion, normally within 14 days of service end. Retrieve your data before the service ends. Deletion is not reversible.
9. Liability
To the extent permitted by law, our aggregate liability in connection with a service is limited to the fees you paid for that service in the three (3) months preceding the event giving rise to the claim. We are not liable for loss of profit, loss of data, loss of business, or indirect or consequential loss.
Nothing in these terms limits liability that cannot be limited under Indian law.
10. Changes to these terms
We may amend these terms. Material changes are notified to the contact address on your account before they take effect.
11. Governing law and jurisdiction
These terms are governed by the laws of India. The courts at Jaipur, Rajasthan have exclusive jurisdiction over any dispute arising from them.
